Client Agreement & Session Terms
Agreement:
This agreement is between D’André Photography LLC, hereinafter referred to as “Photographer", operating in the State of Connecticut, and the "Client", collectively referred to as the "Parties", with the portrait session detailed below.
The package list and price list and/or documents attached to this contract are integral parts of this document. The contract terms, agreement, and price list are the only legally binding documents between the Parties.
1. Pre-Session Consultation:
At the time of booking, the Clients shall provide a general description of their photographic requirements. The Photographer may offer guidance on planning, logistics, and scheduling as necessary.
The client may elect to have a consultation to address any details. D'André Photography LLC will contact the Clients by email days before the scheduled session to confirm the absence of any late-stage changes.
Package: Holiday Mini Session
Cost: $350 + 6.35% = $372.22 (Up to 5 persons)

2. Reservation:
The Client shall pay a non-refundable retainer of $150 (the "Retainer") to the Photographer to secure the Photographer's services for the date and time agreed upon. The Photographer shall reserve the agreed-upon date and time upon receipt of the Retainer.
3. Additional Note for photographing young children
Photographing young kids can be very difficult as it comes down to each child’s personality and their socialization. Just be aware that kids may not smile or give eye contact and you may not necessarily get the reactions you want. The cost is not dependent on whether you get these or not. It’s a risk you are willing to take. If you do not get the reactions or photos, you desired you are still required to pay the full price for the entire session.
4. Payment:
The Client may make payment electronically via invoice. The remaining balance of the Fees (as defined below) shall be due before the scheduled shoot and the final invoice sent the day prior.
5. Fees:
The applicable fees and fee schedule for the contracted services ("Fees"), including any milestones and associated milestone payments, are specified in this Agreement. The Photographer will email a digital invoice to the client for the amounts above. The invoice will be payable online.
6. Delivery of Final Images:
The photographer will deliver the proof gallery within 24 hours of the session or when the final payment is made. The online proof gallery consists of the unedited photos from which you will make your final photo selections. The final photos are delivered in hi-res digital format and the turnaround time is 7 days after I receive the final selections. If you need the edits back earlier than the indicated time, you can opt for the express service.
Note: The unedited proofs are only solely for selection purposes and are therefore watermarked and are NOT intended for personal use.
7. Expedited Delivery Option:
The Client may request expedited delivery of final images. Expedited delivery fees are as follows:
• 1-3 days: $100
• 4-6 days: $75
8. Rescheduling by Client:
The Client may reschedule a session once by providing at least 48 hours' notice prior to the originally scheduled session. The Retainer will be transferred to the rescheduled session, which must occur within 30 days.
Due to the nature of these mini sessions, rescheduled sessions are subject to the Photographer's availability.
The Retainer cannot be applied as credit towards a different individual or group of persons.
If the Client cancels or fails to reschedule in accordance with this policy, the Retainer is forfeited.
9. Client Lateness:
Due to the nature of these Mini-Sessions, its imperative that the Client be on time as session will begin at the scheduled start time. We ask that the Client arrives dressed for the session. If the Client arrives late, the session will still end at the originally scheduled end time. The Photographer is not able to extend the session duration due to Client lateness as these sessions are booked back to back.
10. Non-Refundable Retainer:
The booking fee (Retainer) paid by the Client is non-refundable and serves as compensation for the Photographer's lost opportunity and incurred expenses. The Retainer shall be considered liquidated damages, representing a reasonable pre-estimate of losses resulting from the Client's cancellation.
11. Cancellation Notice:
In the event the Clients cancel the session, the booking fee is non-refundable. It will be considered as liquidated damages to the Photographer.
12. Disclosure:
The Client acknowledges and understands that the Photographer may provide direction and respectfully adjust the Client's positioning, attire, or surroundings during the photoshoot. This is done solely to enhance the composition, lighting, and overall aesthetic of the final images.
The Client agrees to cooperate with the Photographer's reasonable instructions and adjustments. Such cooperation is essential in achieving the desired photographic outcome within the scope of the agreed upon style and services.
13. Final Agreement:
By booking your session, you confirm that:
- You have read and understood this agreement
- You agree to all terms outlined above
- You enter into this agreement willingly
